Marc Rosenberg prevailed in BBC Group v. Island Life Restaurant Group, et al., U.S.D.C., Western District of Washington, Case No. 2:18-cv-01011-RSM. Marc represented a restaurant in a trademark dispute under the federal Lanham Act and Washington’s Consumer Protection Act, in which each party claimed rights to a similar trade name and logo. Claims against the client were dismissed on summary judgment, with the court accepting that the client had a valid and enforceable mark. As to the client’s counterclaims, liability was also established on dispositive motions, and a trial was set for damages. The business day before trial, the opposing party stipulated to an agreed judgment against it in the amount of $200,000.
