Jeffrey P. Downer and Lauren I. Fugere won a motion for summary judgment in Strickland v. Clark Construction, et.al. in King County Superior Court. Plaintiff sued our client, a subcontractor, for the alleged failure to correct a set of stairs that had become displaced from a job trailer on a construction site. The general contractor also sued our client for additional insured coverage and indemnity based on its subcontract. After plaintiff dismissed its claims with prejudice against the subcontractor for lack of admissible evidence, the court dismissed the general contractor’s remaining claims with prejudice because of a lack of evidence that the subcontractor had a contractual duty to indemnify the general contractor. Further, the subcontractor had satisfied its obligation to procure additional insured coverage per their subcontract.
