Jeffrey P. Downer and Andrew H. Gustafson obtained dismissal of plaintiffs’ complaint in Marathon v. Law Firm the Western District of Washington at Seattle. Plaintiffs sued the foreclosure trustee, Jeff and Drew’s client, alleging legal malpractice, violation of the Truth in Lending Act, fraud, and wrongful foreclosure. Plaintiffs claimed the trustee’s mishandling of the foreclosure caused plaintiffs $1,200,000 in damages. Jeff and Drew successfully argued that plaintiffs failed to state a claim upon which relief can be granted, and the court dismissed plaintiffs’ complaint with prejudice.
